Welcome to JamsCity. You’ve just tapped into the music hub for Africa’s next sound wave. These Terms of Service (the "Terms" or "TOS") are the rules for using our platform, website, apps, and services (collectively, the "Service").
By accessing or using the Service, you are agreeing to these Terms. If you don't agree, you can't roll with us.
JamsCity is operated by: Palmnet Digital Concept, based in 51 pound road, Aba, Abia state, Nigeria.
2. Who Can Join the City (Eligibility)

Age Requirement: The Service is intended for users who are at least 16 years old. By using the Service, you confirm you are at least 16. If you are under 18, you must have your parent or guardian review and agree to these Terms on your behalf.

3. The City's Offer (Our Service)
JamsCity provides a digital ecosystem where fans can discover, stream, and share authentic African and Afro-diasporic music, and where creators can upload, distribute, and monetize their original sound.
Access: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service strictly as permitted in these Terms. This means you can stream the music, but you don't own the platform or the underlying content (unless it's your own sound).
4. Your Profile (User Accounts)
To access most features, you need a JamsCity account.

Account Security: You are fully responsible for all activity that occurs under your account. Keep your password locked down. If you think your account has been compromised, notify us immediately.

User Name & Branding: Your username and profile art must not be offensive, misleading, or infringe on anyone's rights. We reserve the right to reclaim or change usernames that violate our rules.
 
5. The Sound (User Content and Licensing)
When you upload content—whether you're an Artist or a Fan sharing a playlist—you are submitting User Content.
A. Your Rights and Our License

Your Ownership: You retain all ownership rights to your User Content (e.g., your master recordings, compositions, and profile images). JamsCity does not claim ownership of your sound.

The Vibe License: By submitting User Content to the Service, you automatically grant JamsCity a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and perform your User Content in connection with the Service and JamsCity's business, including for promoting the Service. This allows us to stream your music, run your profile, and feature your track.

Warranties: You guarantee that you own or have all necessary licenses and rights to submit the User Content, and that your content does not violate any copyright, privacy, or intellectual property laws.
 
B. Prohibited Content
You agree not to upload, post, or transmit any User Content that:

Is illegal, threatening, defamatory, or fraudulent.

Infringes upon any third party's intellectual property rights (including copyright, trademark, and patent).
 - 
Contains viruses, malware, or other harmful code.
 - 
Is spam or unauthorized advertising.
 
6. The Flow (Subscriptions and Payments)

Billing: If you purchase a premium subscription or service ("Premium Service"), you agree to pay the fees and charges in effect at the time the fees are due. All payments are handled by third-party processors.

Cancellations: You can cancel your Premium Service at any time, but your access will typically remain active until the end of your current billing period. Payments are non-refundable, except as required by applicable law.
 - 
Artist Revenue: For Artists, revenue generated through the Service is subject to JamsCity’s separate Creator Distribution Agreement, which governs royalties, payout schedules, and commission rates.
 
7. Rules of the City (Code of Conduct)
To keep the JamsCity vibe positive, you agree not to:

Reverse Engineer: Attempt to derive the source code of the Service.
 - 
Copy/Steal: Copy, reproduce, or modify any part of the Service or its content (other than your own User Content).
 - 
Hate Speech/Abuse: Post or transmit content that promotes violence, discrimination, or unlawful acts against any person or group.
 - 
Scrape: Use automated systems or software to extract data or content from the Service for commercial purposes without explicit written consent from JamsCity.
 
8. Copyright & DMCA (The Respect)
We respect creators' rights. If you believe any content on JamsCity infringes your copyright, please refer to the JamsCity DMCA and Copyright Policy for instructions on how to submit a Takedown Notice. We will swiftly address valid infringement claims.
9. Termination (Vibe Killer)

By You: You can terminate your account at any time by contacting support.

By Us: We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms (e.g., copyright infringement, harassment, fraud). If your account is terminated due to a breach, you are not entitled to a refund for any paid Premium Services.
 
10. Keep it Real (Disclaimers and Liability)
The Service is provided "as is" and "as available," without warranties of any kind, express or implied.
JamsCity is not liable for any losses or damages arising out of your use of the Service, including losses due to reliance on information, loss of data, or interruption of service, to the maximum extent permitted by law.
11. Where We Handle It (Governing Law and Dispute Resolution)

Governing Law: These Terms and your use of the Service are governed by the laws of the Nigeria, without regard to its conflict of law principles.

Dispute Resolution: For any disputes, you agree to first try to resolve the matter informally by contacting us. If a dispute is not resolved within 60 days, both parties agree to resolve the dispute through binding arbitration in Nigeria, rather than in court.
