At JamsCity, we’re all about Empowerment and Authenticity. Our platform is built on the foundation of creator respect, and that means respecting the intellectual property (IP) rights of artists, producers, and labels everywhere.
This policy outlines the procedure for filing copyright infringement notifications (takedowns) and counter-notifications, in compliance with the U.S. Digital Millennium Copyright Act (DMCA) and other applicable laws.
1. Our Commitment to Creators
We do not tolerate copyright infringement. If we receive a valid notice that content on JamsCity infringes someone’s copyright, we will swiftly remove or disable access to that content. We will also terminate the accounts of repeat infringers—because in the City, we respect the source of the sound.
2. The Takedown Vibe (Notice of Infringement)
If you believe that your copyrighted work has been copied and made accessible on JamsCity in a way that constitutes copyright infringement, you must submit a written notification (a "Takedown Notice") to our Designated Copyright Agent.
Your Takedown Notice must include all of the following essential elements:

Physical or Electronic Signature: A signature (physical or electronic) of the person authorized to act on behalf of the owner of the copyright interest.

Copyrighted Work Identification: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
 - 
Infringing Material Identification: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit JamsCity to locate the material (e.g., the URL link).
 - 
Contact Information: Information reasonably sufficient to permit JamsCity to contact you, such as an address, telephone number, and, if available, an electronic mail address.
 - 
Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
 - 
Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
 
3. Pushback (Counter-Notice Procedure)
If your content (which may include music, profile images, or other data) was removed or disabled as a result of a Takedown Notice, and you believe the removal was a mistake—either because the material is not infringing or because you have the necessary rights and authorization to post the content—you have the right to submit a counter-notification (a "Counter-Notice") to our Designated Copyright Agent.
Your Counter-Notice must include all of the following essential elements:

Material Identification: Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which the material appeared before it was removed or access to it was disabled.

Statement Under Perjury: A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

Consent to Jurisdiction: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which JamsCity may be found), and that you will accept service of process from the person who provided the original Takedown Notice (or an agent of such person).

Physical or Electronic Signature: Your physical or electronic signature.
 
Upon receiving a valid Counter-Notice, JamsCity may restore the content after 10 business days, unless the original claimant files a court order seeking to restrain the subscriber from engaging in infringing activity.
4. The Three-Strikes Policy (Repeat Infringers)
JamsCity adheres to a strict repeat infringer policy. If a user is determined by JamsCity to be a repeat copyright infringer, their access to the platform, including all user-generated features and content publishing rights, will be terminated immediately and permanently.
